It was a mere four years ago that we were first introduced to those phone calls, from people who we would normally never get phone calls from, urging us to run out and vote.

Many of us on the ‘Do Not Call List’ scratched our heads wondering why we had to be bothered by these calls. Here is what you need to know about those calls.

The Season of those Political Robocalls

Robocalls are prerecorded messages that play when the phone answers- whether it be you picking it up or an answering machine.

According to the FTC, as of September 1st, 2009, most businesses have been allowed to use prerecorded telemarketing messages only when calling consumers who have given written permission to accept them.

Are you on the Do Not Call List?
The FTC says that it doesn’t matter whether or not you are on the National Do Not Call Registry, or whether the call is answered by a person or voicemail service.

If a business delivers a prerecorded telemarketing messages to you without your permission, they’ll face penalties of up to $16,000 per call.

Exceptions to the Robocall Rule

Yep, it’s true, political organizations are exempt. This means you’ll moat likely be getting those calls if you live in the US.

Who else can Robocall you?
• health care providers covered by HIPPA; and
• banks, telephone carriers and charities that make the calls themselves.
• informational calls such as information about your air flight

Good news- Prerecorded Messages from businesses Must Allow Consumers to Opt Out

Robocallers must tell people how they can opt out of these calls, and provide an automated interactive opt-out mechanism that responds to a keypress or spoken request.

Remember in the 2011 Superbowl ad for Shape-ups which showed Kim dumping her personal trainer for a pair of Shape-ups. The Burke ad told consumers that the newest way to burn calories and tone and strengthen muscles was to tie their Shape-ups shoe laces.

Actress Brooke Burke had a Sketcher’s ad which told consumers that the newest way to burn calories and tone and strengthen muscles was to tie their Shape-ups shoe laces.

Charging between $60 and 100, Sketchers made millions of dollars off on the claims they made;
• claims about strengthening;
• claims about weight loss; and
• claims about any other health or fitness-related benefits from toning shoes, including claims regarding caloric expenditure, calorie burn, blood circulation, aerobic conditioning, muscle tone, and muscle activat

The FTC says that Skechers violated federal law by making deceptive advertising claims, including falsely representing that clinical studies backed up the claims.

Skechers settled with the FTC. Under the settlement, Skechers USA has agreed to pay $40 million to provide refunds to people who bought Skechers toning shoes and they are barred from making the claims listed above for its toning shoes unless they are true and backed by scientific evidence.

Did you get ‘Skechered?’ What to do about it.

You may be eligible for a refund.

The Federal Trade Commission, the nation’s consumer protection agency, charged Skechers with making unfounded claims that its Shape-ups and other “toning shoes” would help people lose weight and tone their buttocks, legs, and abdominal muscles.

To settle the case, Skechers USA has agreed to pay $40 million to provide refunds to people who bought Skechers toning shoes.
